Jingle: A sung advertising piece created specifically to promote a brand, product or campaign. It uses melody and lyrics to convey the message in a memorable way and reinforce brand identity. Available in 15, 30 (the most used), 45 and 60-second lengths. It’s the most effective of all.

Advertising Spot: A spoken ad, usually featuring professional voiceover and background music, used to promote products, services or campaigns in a direct and informative way. The jingle is a musical creation developed specifically for a company’s campaign. After production, the client can use it normally in their advertising activities.

When the campaign remains active in the following years, only an annual usage renewal is made, corresponding to a percentage of the production’s current value.

This renewal exists because the jingle involves the participation of professionals such as singers and voice talents. For market ethics reasons, while the campaign is in use, these voices cannot record for competing companies in the same segment.

For example: if a singer recorded a jingle for a supermarket, while that jingle is airing she cannot record for another competing supermarket.

This way, the renewal guarantees continuous use of the advertising piece and respects the work of the professionals involved in the production.
The timeline depends on the complexity of the project, but generally producing a jingle can take from a few days to about a week, including creation, recording and finishing.
In Brazil, musical works are protected by the Copyright Law (Law 9.610/98), which recognizes as protected works the creations of the human spirit, including musical compositions with or without lyrics.

When a song, jingle or soundtrack is created by a composer, the copyright and commercial rights are clearly defined and protected by law, ensuring legal certainty for those who use the work in advertising campaigns.

In the case of AI-generated content, the situation is still a matter of legal debate in many countries. Since it is not a direct human creation, authorial protection and the work’s exclusivity can be called into question.

Furthermore, AI systems are trained on large musical databases, which can produce results similar to existing works or even to other companies’ campaigns.

For this reason, in professional advertising productions, musical creation by a composer remains the safest way to guarantee originality, exclusivity and legal protection of the work.
